CLIMATE CHANGE KENYA PARLIAMENT IS A CRIME SCENE.
REF: DEMAND FOR RECALL AND A PROPER PROCEDURAL ON CLIMATE CHANGE (AMENDMENT) BILL, 2023 ENGAGEMENT.
Addressed to Kenya Senate Speaker.

The world 8 Billion populace will from Monday 4-6th
September 2023, await the resolutions and commitments passed in Africa Climate
Summit an e ent hosted by Government of Kenya and the African Union, its
estimated over 30 World leaders have confirmed participation, and over 30,000
delegates participants, the event will therefore highlight each country in
Africa their commitments towards achievement of change the planet so urgently
needs. This event hosted in Kenya, will grant President Ruto an opportunity to
share his vision for Africa Green, Climate- Positive Economic Growth.
We therefore take this earliest opportunity to
DEMAND cancellation and re advertisement of Climate Change (Amendment)
a
proper invite for public participation process on Climate Change (Amendment)
2023, we also demand that the National Assembly move with speed and formulate a
Public Participation Act which falls squarely as a money bill.
Its impunity of the highest order for the
Clerk of the Senate to purport to invite citizens in a record one day, invite
in a local newspaper advert dated 29th August 2023 for submission of
memoranda into the Climate Change (Amendment) Bill, 2023 with a deadline for
submission the following day 30th August 2023.
Such a travesty of justice and coming a few
days before the country hosts (ACS) summit, which over 25 Head of states and
over 30,000 delegates from various countries in Africa will be participating
in, amounts to a national shame and irresponsibility.
To state the least its heartbreaking and
unfathomable to witness the heinous gravious actions perpetuated by the Kenya
Parliament especially in regards to climate Change policy formulation, since its formulation the Climate Change Act 2016 was designed in a way to favors
multinationals against the rights of indigenous communities, peasants farmers,
fisher folks and traditionalists,i.e who ? Benefits from intellectual
properties rights.
We therefore demand revocation of the above
bill and proper and effective law guiding Public Participation be enacted, its
heart breaking that since Kenya Constitution became effective that both the Senate
and National Assembly have failed to enact a proper effective Public
Participation Act, numerously we have petitioned for the same without success.
Kenya is a signatory to 17 Sustainable
Development Goals which among other has a rallying call for “Leave No One
Behind” commencing with the above process of drafting the Climate Change (Amendment) 2023, without
proper procedures amount to violation of the international treaty thus our Demand for proper procedures
and formulation of Public Participation Act which forms the basis of a proper
procedure.
Its attestable that Climate Change amendment
bill and its mother Act-Climate Change Act 2016 is an omnibus kind of law,
which must be given an ample time for meaningful engagements..
We have witnessed several acts being
formulated in Parliament, where an email is indicated for citizen’s submissions,
the lingering question? Who validate the citizen’s views, we are calling out
for this subtle law abuse.
We call for Senate-Speaker to revoke print
media Advert dated 29th August 2023 an advert that gives citizen 1
day to submit their views in regards to Climate Change (Amendment 2023) bill.
